Qυеѕtіοn bу Anjel: Cаn a doctor “legally” deny уου a Hysterectomy bесаυѕе οf уουr age?
Mу daughter іn law hаѕ several “Ovarian Cyst” ( one іѕ 7cm іn diameter) аnd ѕhе hаѕ “Andramesotrous”,(don’t know hοw tο spell іt, bυt іt’s whеn thе lining οf thе Uterus іѕ coming out) ѕhе′s 27 аnd hаѕ one child already аnd dοеѕ NOT want аnу more. Thе doctors ѕау ѕhе needs a hysterectomy bυt refuse tο give hеr one bесаυѕе οf hеr age, јυѕt іn case ѕhе wаntѕ another child,saying ѕhе needs tο bе older (mid-30′s). Thе pain іѕ ѕο horrific thаt ѕhе іѕ іn thе ER аt lеаѕt twice a week.
Cаn a doctor legally deny a persedure thаt thеу themselves ѕау ѕhе needs bυt bесаυѕе οf hеr age won’t dο? Cаn thеу bе held іn ѕοmе form οf “Mal-pratice” bу allowing hеr tο live іn such pain аnd termoil?

    No, a Dr. CANNOT deny her this procedure because of her age. If she is sure she doesn’t want another child, and the Dr. says she needs one, it needs to be done. Not having it will lead to worse problems in the near future. Get her records from this Dr. and get a 2nd opinion. Some Dr.s have surpassed their malpractice insurance, and cannot be sued. I had this problem with a former Dr. of mine. You can however, report this Dr. to the AMA, and spread the word.

    they cant do that my mom got one when she was 25-26 and is now 33 almost 34!!!

    Well, you may eventually locate a doctor who will agree to do the hysterectomy, but I’m with the doctor on this one. Let’s try different methods first… if both fail, then go for the hysterectomy.

    Ovarian cysts and other uterine problems develop due to either hormone imbalance or structure imbalance with the pelvis which makes sense since having a child can certainly disturb the pelvis and also change hormone levels. Try acupuncture which has a good success rate for hormone balance and also good for pain management. If that doesn’t work out, I also recommend chiropractors who are trained in Gonstead method.

    It’s endometriosis (pronounced endo-me-tree-osis). It’s when tissue grows outside of the uterus (like the fallopian tubes or abdominal cavity for example). When the period cramps come on then they are not just felt in the lower back like normal but wherever the extra tissue has migrated to. The hormones act on it all and make all of the areas it is found painful. I woulld recommend that she get a second and maybe even third opinion if necessary. No one should have to live with that kind of pain!!!

    I opted for a hysterectomy at the age of 27 for much less difficulties than what you have described. However, there was nothing wrong with my ovaries so they were left. But due to adhesions and chronic pain during ovulation, I had them removed less than 10 years later.

    She simply needs a second opinion or as I always say about doctors…

    I would think that a doctor can legally refuse to perform any procedure. In your relatives case, though, it makes no sense because I doubt that she could reproduce in her present condition anyway. My wife had the same condition two years ago and we both know about the intense pain. Your daughter-in-law needs to see another doctor – now. Good luck.

    She needs to find a new doctor!!! If she has a child already, her husband is most likely willing to sign agreement for the procedure and the doctors say she needs one- then what is the problem? They may be doing this on ethical grounds more than legal ones. But if she is asking for the hysterectomy because of her health issues and the pain she is in- which is not fixable- then by all means they should comply.

    Well now you can say you have two daughter in Laws with the sma type of problem they wouldnt takemine out when I had the twins now that my body is doing the same things almost they still wont take it out because of my age! call you later tho withb what their now saying

    A doctor can “legally” decline to do any procedure unless it is an immediate life or death situation. You should find another doctor who is more sympathetic to your situation. I am certain you wont have too much trouble finding a doctor that is willing to do the procedure.
